Quick Answer: The most common home remodeling scams in San Jose and the Bay Area include: (1) unlicensed contractors offering suspiciously low bids, (2) large up-front payment demands (over 10% or $1,000, whichever is less, is illegal in California), (3) storm chasers targeting roof and structural repairs after earthquakes or storms, (4) contractors who “discover” unexpected problems mid-project to inflate the price, and (5) bait-and-switch — low initial bid replaced by change orders. Always verify CSLB license at cslb.ca.gov before signing.
8 Red Flags for Remodeling Scams in San Jose
Helpful Resources:
| Red Flag | What It Means | What to Do |
|---|---|---|
| Cannot provide CSLB license number | Unlicensed — illegal for jobs over $500 | Verify at cslb.ca.gov before any payment |
| Demands large down payment (over $1,000 or 10%) | Violates California Business Code §7159 | Refuse and find another contractor |
| Pressures for “today only” pricing | Manipulation tactic — legitimate GCs don’t do this | Walk away and get 2 more bids |
| Offers to do work “without permits” | Creates legal liability and disclosure issues | Always require proper permits |
| No physical business address | Fly-by-night operation | Require street address, verify on Google Maps |
| Bid is 30%+ below competitors | Low-ball bid; expect change orders or poor quality | Get 3 bids; question outliers in either direction |
| Knocks on door after storm or disaster | “Storm chaser” — often targets seniors | Initiate contact yourself; don’t sign same day |
| Asks you to sign over insurance claim | Assignment of benefits (AOB) — often fraudulent | Never assign insurance benefits to a contractor |
How the CSLB Protects San Jose Homeowners
California’s Contractors State License Board (CSLB) investigates complaints against licensed and unlicensed contractors. In 2023, CSLB’s “Statewide Investigative Fraud Team” (SWIFT) cited 243 contractors and arrested 23 for fraudulent contracting activity across California. Licensed contractors in good standing are subject to discipline, bond forfeiture, and license suspension if found to have defrauded homeowners.
- File a complaint: cslb.ca.gov/consumers/file_a_complaint — CSLB investigates both licensed and unlicensed contractor fraud
- Victims of contractor fraud: May be eligible for compensation from the CSLB Contractors License Bond (up to $15,000 for licensed contractors)
- Small claims court: For disputes under $12,500, small claims court in Santa Clara County (San Jose) is an option
Frequently Asked Questions
What is the maximum legal down payment for a contractor in California? Under California Business and Professions Code Section 7159, contractors cannot legally demand more than 10% of the total contract price OR $1,000 — whichever is less — as a down payment before beginning work. Any contractor who demands more upfront is violating California law.
How do I report an unlicensed contractor in San Jose? Report unlicensed contractors to the CSLB’s complaint system at cslb.ca.gov or call the CSLB at 1-800-321-CSLB (2752). You can also report to the Santa Clara County District Attorney’s consumer protection division for criminal fraud cases.
What should a valid contractor contract include in California? California law requires contractor contracts to include: contractor’s name, license number, and address; a description of the work; a payment schedule; a start date and estimated completion date; a change order clause; and a notice of the homeowner’s right to cancel within 3 business days (for contracts signed at the homeowner’s home).
